LEGAL - Release of Liability and Waiver
A Copy of this form will be given to anyone who wishes to use our Dynamometer facilities & services, and will need to be filled in with your details and signed before going any further.
A full diagnostic check of all vehicles is carried out prior to and after any ECU remap or programming service is carried out by us. All vehicles may be driven on the road for testing and/or data logging purposes.
For your Safety - We do not allow customers to be in the workshop when Dyno runs are being carried out.
Engine Control Unit (ECU) - While carrying out remapping and reprogramming of the vehicle ECU, we take
full responsibility for the engine control unit and its operation. In the unlikely case that any issue arises
during the flash programming process of the ECU, then we will strive to carry out recovery, repair or
replacement of the ECU as required.
Other Mechanical / Electrical faults - We do not accept liability for any other vehicle mechanical or electrical failure or faults prior or after the remapped ECU software has been installed. We will also not be held liable for any emission control bypass software used on the public highway - these vehicles must continue to
comply to UK / Euro emissions standards and meet MOT requirements as required by law.
Engine / Vehicle Health – It is the customers responsibility to ensure the vehicle and engine is in good health when provided to us for remapping. We reserve the right to refuse to provide our remap service if any suspect issues are identified with the vehicle following our own initial diagnostic and health check. We will
offer full advice regarding any issues identified where required.
Vehicle Warranty – It is the customers responsibility to ensure their vehicle warranty is not affected by the
installation of custom ECU software.
Return to Stock – In all cases possible, we will carry out full backup of the vehicle ECU manufacturer software on the vehicle as provided to us. This will allow the customer to return to their previous factory ECU software if ever required.
Previously Tuned - In the case of your vehicle being previously tuned, you will be informed if it is not possible to return to previous software before any work is carried out and that you might be left with manufacturers factory software ECU afterwards.
Disclaimer - As the “Customer” I hereby represent that I have read and completed the required procedures and checks and that I have full authority to authorise the testing/tuning of this vehicle and to enter into this Waiver/Release.
I am aware that all tests are intended to be and will be at maximum performance and at wide-open throttle, thus applying stress similar to that which the vehicle would experience during operation on the road/track and is therefore susceptible to the same as on the road/track which may cause engine, power train and/or tire/wheel failure or damage.
As the “Customer” I hereby represent that I know the condition of the vehicle and I assure that it is in an acceptable condition to run on the Dynamometer. I have been advised that AGT Performance does not know, nor assumes any such knowledge of the condition of the vehicle being tested/tuned and I nevertheless, agree to have my vehicle run on the Dynamometer. As the “Customer” I represent that all parts of the vehicle are in good condition and are capable of full power and full throttle performance during any testing/tuning being performed.
I hereby authorise and release the dynamometer tests and/or service work to be done along with the necessary materials, parts and labour and hereby grant AGT Performance and its employee’s permission to operate the vehicle or combustion engine herein described in the document below on the dynamometer, for the purpose of testing and tuning. I hereby acknowledge and voluntary release and forever discharge, AGT Performance, its employees, directors, and officers from any and every claim, demand, action or right of action of whatever kind or nature, either in law or equity, arising from or by reason of any bodily or personal injury, death, or property damage, known or unknown, resulting to or resulting from the owners/operators of dynamometer test equipment.
This release also includes, but is not limited to, any claim against AGT Performance for first aid, medical treatment or services rendered during participation in the test of this vehicle. AGT Performance and its employees, directors and officers are in no way responsible for ANY damage to your vehicle incurred before, during or after your vehicle is operated on the Dyno. I hereby acknowledge that I am aware of the potential risks involved with Dyno testing / tuning and that I waive any and all claims against AGT Performance, its employees, directors, and officers for ANY damage to my vehicle as a result thereof.
As the “Customer” I know and accept the risk of running my vehicle on the dynamometer.
